This summer, Canada will become the second country in the world to legalize marijuana for recreational use. But it’s not new – substance use, including marijuana, has been an issue for employers for generations. While many trucking companies have been addressing drug use via DOT testing protocols for cross border work, these requirements will not translate effectively to Canadian workplaces. Dave Earle (bio) will provide a brief history of substance use in Canada, review current case law and technology and contrast the difference between determining impairment and prohibition testing. He will discuss when employers have to accommodate disability and medial use (and when they don’t) as well as when and how to discipline. Participants will leave with an understanding of what this new requirements means for their operations and practical tools to address substance use in their workplaces.
